The U.S. Department of Justice has released a statement backing Elon Musk and X in their legal fight against the European Commission.• The United States has formally asked to intervene in support of Elon and X before the EU’s General Court in Luxembourg.• Elon and X are seeking to overturn the European Commission’s December 2025 decision, which imposed a €120 million fine over alleged Digital Services Act violations.• The DOJ says the Commission engaged in “regulatory overreach” by extending its authority to American companies that were not operating within its jurisdiction.• It argues that the EU unfairly targeted Elon personally and implicated separate American companies he owns, even though they had no connection to the digital services involved.• The DOJ also raised concerns about extraterritorial jurisdiction and the Commission looking beyond X’s corporate structure to hold its shareholders responsible.• This is the first challenge to a DSA enforcement decision to reach the EU’s General Court.• The filing was prepared with the U.S. State Department because the outcome could affect other American technology companies and U.S.-EU relations.This is bigger than Elon or X.
