CEC Gyanesh Kumar: Why India’s Election Commission is in the eye of a storm again 🚨India’s Election Commission (ECI) — traditionally one of the most trusted institutions in the world’s largest democracy — is facing a fresh and serious credibility crisis. The controversy centres on Chief Election Commissioner (CEC) Gyanesh Kumar.What Triggered the Latest Storm?An investigative report by The Indian Express (published 23 September 2026) revealed that:• The two other Election Commissioners — Sukhbir Singh Sandhu and Vivek Joshi — formally objected at least 14 times in the past 10 months to decisions taken by CEC Gyanesh Kumar.• Many of these decisions were allegedly taken without their knowledge or approval.Key areas of disagreement included:• Integrity and security of the voter database • Changes in the process of enrolling new voters (especially modifications to Form 6) • Centralisation of control over electoral rolls in Delhi • Deletion and restoration of voter names • Overall management of the Special Intensive Revision (SIR) of electoral rollsIn one instance, the two commissioners even wrote a formal letter of complaint to the Cabinet Secretary (the top bureaucrat in the central government).Political Fallout • Opposition parties (led by Congress’s Rahul Gandhi and others) have strongly demanded that Gyanesh Kumar resign. • Some leaders have called for his arrest or impeachment, accusing the ECI of “vote theft” and bias in favour of the ruling BJP. • This is not the first time the ECI under Gyanesh Kumar has faced allegations. The POCSO Presumption & Standard of Rebuttal Case 🚨Deepak IN JC v. State Govt. of NCT Delhi (2026 INSC 1008) Diary No. 59000/2025✳️ The Hon’ble Supreme Court has given a remarkable decision in a criminal appeal case and has acquitted the appellant-accused. The appellant has been convicted u/S.363 IPC and S.6 r/w S.29 of POCSO Act.✳️ The prosecution had alleged that the accused had taken a minor girl aged 2.5 years with him without the knowledge of her mother. Later, her mother alleged that she found blood stains on her ‘pyjami’. Hence, the Trial Court convicted the man under presumption of S.29 of POCSO Act.✳️ The SC said that the statutory presumptions given in S.29 and 30 of the POCSO Act are not absolute presumptions and the reverse burden of proof upon the accused must be supported by prosecution evidence. The Court relied on Naresh Kumar
